Clarinet Keyboard Corporation, dba EkaTetra ("EkaTetra") warrants to the original purchaser that the EkaTetra EkaPad data entry device (the "Product") will be free of defects in workmanship and materials, under normal use, for a period of one year from the date of original purchase from EkaTetra. During this warranty period, EkaTetra will, at its sole discretion, repair or replace the Product at EkaTetra's expense. EkaTetra's obligation to repair or replace, at EkaTetra's option, shall be your sole and exclusive remedy under this warranty.
Excluded from this warranty is any damage caused by: improper use, unauthorized modifications, tampering, power surge, misuse, abuse, negligence, accident, wear and tear, mishandling, misapplication, or other causes unrelated to defective materials or workmanship, or if the Product is not used in accordance with the accompanying documentation and use instructions, or is repaired, modified or altered by other than EkaTetra. EkaTetra's sole liability under this warranty, for failure to repair or replace the Product, is limited to refund of the original purchase price. EKATETRA LIMITS THE DURATION OF ANY LEGALLY IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE DURATION OF THIS WARRANTY. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state. Where any term of this Limited Warranty is prohibited by such laws, it shall be null and void, but the remainder of the Limited Warranty shall remain in full force and effect. This Limited Warranty is available only to the original purchaser and is non-transferable.
To the fullest extent allowed by law, EkaTetra excludes for itself and its suppliers any liability (whether based in contract or in tort, including negligence) for incidental, consequential, indirect, special, or punitive damages of any kind, or for loss of revenue or profits, loss of business, loss of information or data, or other financial OR OTHER loss arising out of or in connection with the purchase, installation, use, performance, failure, or interruption of the Product, even if EkaTetra or its authorized reseller has been advised of the possibility of such damages, and limits its liability to replacement, repair, or refund of the purchase price paid, at EkaTetra's option . This disclaimer of liability of damages will not be affected if any remedy provided herein shall fail of its essential purpose. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
Contact the EkaTetra support team first by e-mail at support@ekatetra.com or by telephone at 503-697-0604 to determine whether the Product should be returned for repair or replacement before shipping. If appropriate, an EkaTetra representative will authorize the repair or replacement of the Product, and may request that you return the Product to EkaTetra. Upon such request, please carefully package and send the Product to the address provided by the EkaTetra support team, along with any authorization required. You are responsible for shipping costs when returning the Product for warranty service. EkaTetra will pay return shipping costs for returning the repaired or replaced Product to you.
