Important Notice: You are responsible for determining whether the items included in the Ultimate Gadget Mount kit are fit for the purpose you plan and that the gadget, the attachment of the gadget, and its mounting location are suitable for your intended application. Clarinet Keyboard Corporation, dba EkaTetra ("EkaTetra"), warrants to the original purchaser of this product that it will be free from defects in materials and workmanship for a period of one year from date of original purchase. During the warranty period, EkaTetra will repair or replace, at its option, any product or part which is found to be defective under normal use and service. EkaTetra's obligation to repair or replace, at EkaTetra's option, shall be the purchaser's sole and exclusive remedy under this warranty.
This warranty does not apply to any product failure caused by modification, misuse, negligence, accident, improper maintenance or repair other than by EkaTetra.
EKATETRA LIMITS THE DURATION OF ANY LEGALLY IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, TO THE DURATION OF THIS WARRANTY, AND MAKES NO AND DISCLAIMS ANY WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. EKATETRA SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES ARISING OUT OF, OR IN CONNECTION WITH THE PRODUCT, INCLUDING THE USE AND PERFORMANCE OF THE PRODUCT, EVEN IF IT HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
EKATETRA'S LIABILITY FOR ANY DAMAGES TO YOU OR ANY PARTY SHALL NOT EXCEED THE PURCHASE PRICE YOU PAID, REGARDLESS OF THE FORM OF ANY CLAIM.
